Terms and Conditions

§1 Applicability to Entrepreneurs and Definitions

(1) The following terms and conditions apply to all deliveries between us and a consumer in their version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that can predominantly be attributed neither to their commercial nor independent professional activity (§ 13 BGB).

 

 

§2 Conclusion of a Contract, Storage of the Contract Text

(1) The following regulations concerning the conclusion of a contract apply to orders placed via our online shop at http://www.passionmode.de.

(2) In the event of a contract conclusion, the contract is formed with:

(3) The presentation of goods in our online shop does not represent a legally binding contract offer; instead, it is a non-binding invitation for the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer for the conclusion of a purchase contract.

Acceptance of the offer is given in writing, in text form, or by sending the ordered goods within one week. If the offer is not accepted within this period, it is deemed rejected.

(4) When placing an order in our online shop, the following steps apply: The consumer submits a binding offer by successfully completing the order process provided in our online shop.

The order process includes the following steps:

  • Selection of desired goods
  • Confirmation by clicking the “Order” button
  • Review of items in the shopping cart
  • Click the “Checkout” button
  • Register in the online shop and log in with account credentials (email and password)
  • Review and correct any entered data
  • Submit the order by clicking the “Order with obligation to pay” or “Buy” button

Before submitting the order, the consumer can correct input errors or cancel the order process by closing the browser. We immediately confirm receipt of the order with an automated email (order confirmation). This does not yet constitute acceptance of the offer. Acceptance occurs in writing, in text form, or by dispatching the ordered goods within one week.

(5) Storage of the contract text for orders in our online shop: We will send you the order data and our Terms and Conditions by email. You can view the Terms and Conditions at any time on our website at http://www.passionmode.de/agb. For security reasons, your order data will no longer be accessible over the internet.

 

 

§3 Prices, Shipping Costs, Payment, Due Date

(1) Prices listed include statutory VAT and other price components. Shipping costs may apply.

(2) Consumers can pay via advance payment, cash on delivery, PayPal, or credit card (Visa, Mastercard, American Express).

(3) If the consumer selects advance payment, they must pay the purchase price immediately after the conclusion of the contract. For cash on delivery, payment is due upon receipt of the goods.

§4 Delivery

(1) Unless otherwise clearly stated in the product description, all items are ready for dispatch immediately. Delivery occurs within 4 business days. For advance payment, this period begins the day after the payment order to the transferring bank, and for all other payment methods, the day after the contract conclusion. If the period ends on a Saturday, Sunday, or legal holiday at the delivery location, it extends to the next business day.

(2) The risk of accidental loss and accidental deterioration of the sold item transfers to the buyer upon handover.

 

 

§5 Retention of Title

We retain ownership of the goods until full payment of the purchase price.

 

 

§6 Right of Withdrawal for Consumers

Consumers are entitled to a right of withdrawal as per the following guidelines, where a consumer is any natural person entering a legal transaction for purposes outside their trade, business, or profession:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date on which you or a third party designated by you, who is not the carrier, takes possession of the goods.

through an explicit statement (e.g., a letter sent by post, fax, or email) about your decision to withdraw from this contract. You may use the attached sample withdrawal form, though it is not mandatory.

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (except for additional costs if you chose a delivery method other than the least expensive standard delivery offered by us), within fourteen days from the date we receive your withdrawal notice. The reimbursement will use the same payment method used in the original transaction unless expressly agreed otherwise; no fees will be charged for this reimbursement.

We may withhold the reimbursement until we have received the returned goods or you have provided proof of their return, whichever occurs earlier.

You must return the goods promptly and in any event within fourteen days of informing us of your withdrawal. The deadline is met if you send the goods before the end of the fourteen-day period.

You bear the direct cost of returning the goods.

§11 Special Agreements on Offered Payment Methods

  1. Credit Check
    If we provide services in advance, such as payment by invoice or direct debit, we reserve the right to conduct a credit check to protect our legitimate interests. For this purpose, we may forward your data to SCHUFA Holding AG (Komoranweg 5, 65201 Wiesbaden) for assessment based on mathematical and statistical methods. Based on the outcome of the credit check, we reserve the right to deny certain payment methods, such as invoice or direct debit.

  2. Payment via Klarna
    We collaborate with the payment provider Klarna Bank AB (publ) (Sveavägen 46, 111 34 Stockholm, Sweden; “Klarna”) to offer the following payment options. Payment is processed directly through Klarna:

    • Installment Plan (“Financing”): Details, including the general terms and European consumer credit information for Germany, are available here. Terms for “Pay in 3 installments” are also available here.
    • Direct Debit (“Pay Now”)

    Please note that using Klarna’s invoice, installment, and direct debit options is conditional upon a positive credit check. For this reason, during the purchase process, we forward your data to Klarna for the purpose of address and credit verification. Based on the results of this check, we can only offer you payment methods that meet Klarna's approval criteria.

  3. Payment via "PayPal" / "PayPal Checkout"
    If you select a payment option offered by "PayPal" / "PayPal Checkout," your payment will be processed through PayPal (Europe) S.à.r.l. et Cie, S.C.A. (22-24 Boulevard Royal L-2449, Luxembourg; “PayPal”). The individual payment options offered via "PayPal" are displayed on our website and during the online ordering process.
